In California, and across the country, federal laws have been implemented to protect the educational rights of children with disabilities. These laws fall under the framework of the Individuals with Disabilities Education Act (IDEA). IDEA mandates school districts to provide a Free Appropriate Public Education (FAPE) to all children between the ages of 3 and 21.
To comply with IDEA, school districts must provide specially designed instruction and related services, as appropriate, to meet the needs of an eligible child. There is no out of pocket expense for parents to obtain these services.
To be eligible, a child must be found to be a “child with a disability”. IDEA provides several conditions that may qualify a child. They are:
- Mental impairment
- Hearing impairment (including deafness)
- Speech and language impairment
- Visual impairment (including blindness)
- Serious emotional disturbance
- Orthopedic impairment
- Traumatic brain injury
- Specific learning disability, or
- Other health impairment
